These Messaging Terms & Conditions (“Messaging Terms”) are a supplement to the general Terms of Use and Privacy Policy of FigureIt-Out.com. If there is a conflict between these Messaging Terms and the general Terms of Use, these Messaging Terms will govern with respect to text messaging (SMS/MMS) services.
By opting in to receive text messages from Garvin Antoine of FigureIt-Out.com (the “Company”, “we”, “our”), you agree to these Messaging Terms.
1. Definitions
- “You” / “User” / “Subscriber” means any individual who consents to receive SMS or MMS messages from us.
- “Message(s)” means SMS or MMS communications we send or receive in connection with your use of our services.
- “Program / Campaign” means the particular messaging campaign (e.g. alerts, reminders, promotions) under which messages are sent.
- “Carrier” means wireless mobile carriers over whose networks messages are delivered.
- “Data & Message Rates” means standard messaging and data fees charged by your mobile carrier.
2. Consent / Opt-In
- You expressly consent to receive recurring (or non-recurring) automated text messages from us (via our service provider(s)) at the mobile phone number you provided.
- Consent is not a condition of purchase.
- Message frequency may vary.
- Standard message & data rates may apply per your mobile plan.
3. Description of Message Types
We may send you messages including (but not limited to):
- Appointment reminders, notifications, updates
- Program or course alerts, coaching prompts
- Marketing or promotional offers (only if you opt in to promotional messaging)
- Administrative or service messages
4. Opt-Out / Unsubscribe
- You can opt out of receiving further messages at any time by replying STOP, END, QUIT, UNSUBSCRIBE, CANCEL, or REVOKE (case insensitive).
- After opt-out, you will receive one final confirmation message confirming your unsubscription.
- You may also reply HELP (or SUPPORT) for assistance or customer care.
- Opt-out requests will be honored promptly (within a reasonable period).

- We make reasonable efforts to deliver messages but do not guarantee delivery, timeliness, or receipt (e.g. due to carrier delays, downtime, network issues).
- Carriers are not liable for delayed or undelivered messages.
- Message delivery may be affected by your device, network, settings, or carrier.
7. Privacy & Data Sharing
- Your mobile number, messaging opt-in status, and interactions are handled in accordance with our Privacy Policy (linked here ).
- No mobile information (opt-in data) will be shared with third parties or affiliates for marketing or promotional purposes.
- We may share information with subcontractors or service providers solely for the purpose of delivering the messaging service (e.g. SMS gateway, analytics).
- We may also disclose information if required by law, legal process, or to protect rights or safety.
8. Compliance with Laws & Carrier Rules
- You acknowledge that messaging services are subject to applicable laws and regulations, including the Telephone Consumer Protection Act (TCPA), CTIA Messaging Principles & Best Practices, and carrier rules.
- We reserve the right to suspend or terminate messaging privileges if we determine there is non-compliance or abuse.
- Messages must not contain prohibited content (fraud, harassment, spam, illegal content). Violations may result in blocking, fines, or account suspension.
9. Changes to These Terms
We may update or change these Messaging Terms at any time. We will post the revised terms on our website and indicate the effective date. Your continued enrollment in SMS services constitutes acceptance of changes.
10. Liability, Disclaimers & Indemnification
- In no event shall we be liable for indirect, incidental, special, consequential, or punitive damages arising from messaging.
- Our total liability for any messaging-related claims is limited to the lesser of $100 or the amount you paid us (if any) in the prior month.
- You agree to indemnify and hold us harmless from any claim, loss, liability, damage, or cost (including attorneys’ fees) arising from your violation of these Messaging Terms or any applicable laws.
11. Miscellaneous
- These Messaging Terms are governed by the laws of [State / Country].
- If any provision is invalid or unenforceable, the remainder will remain in full force.
- These terms are in addition to and do not replace any other contractual rights or obligations between you and the Company.
